General Terms and Conditions Skyglide Paragliding Lake Lucerne Ltd.

1. CONCLUSION OF THE CONTRACT

Upon verbal or written registration or booking by the customer, which can be made with Paragliding Lake Lucerne GmbH (hereinafter referred to as the organiser) or one of its sales outlets, a binding contract is concluded between the customer and the organiser. By making a booking, the customer acknowledges these general terms and conditions as part of the contract between them and the organiser.

 

2. SUBJECT MATTER OF THE CONTRACT

The organiser undertakes to provide the service requested by the customer within the scope of the tenders and/or the order confirmation. Service extensions may be considered after consultation with the organiser. Any additional costs shall be borne by the customer.

 

3. PRICES

The applicable prices for the events offered can be found in the organiser's current advertisements. The prices in the brochure are per person in Swiss francs. We expressly reserve the right to change prices.

 

4. TERMS OF PAYMENT

The booked events must be paid for as follows before the start of the activity:

Total amount no later than the day of the event.

Vouchers are issued with an enclosed invoice. The total amount of the invoice must be paid within 10 days. The date of invoicing is decisive.

 

Payments not made on time entitle the organiser to refuse to provide services or to withdraw from the contract. Any cancellation costs resulting from this will be charged to the customer in accordance with section 5 below. The number of participants reported at the time of withdrawal from the contract or refusal to provide services shall serve as the basis for this.

 

5. CANCELLATION OR CONTRACT AMENDMENT BY THE CUSTOMER

Annullierungen von Verträgen haben schriftlich zu erfolgen. Diese sind nur nach Rücksprache mit der Veranstalterin und deren Einverständnis gültig.

In the event of a complete cancellation, the customer will be charged the following percentages of the total cost of the booked event:
For group bookings (more than 5 participants):
20–10 days before the activity: 30%
9–3 days before the activity: 75%
2 days before the activity or no-show: 100%

 

For individuals (up to 5 participants):
From 48 hours before the activity: 100%

 

For third-party services, the cancellation conditions of the respective service providers apply. Any costs incurred in this regard may be invoiced additionally.
In the event of a partial cancellation of group reservations (reduction in the number of participants), the contracting party will be charged the following percentages of the total cost of the booked event per person
9–3 days before the activity: 30%
2 days or less before the activity: 100%
If the customer arrives late or leaves the event early, there is no entitlement to a refund
Additional costs incurred as a result of late arrival, early departure or postponement of the event shall be borne by the customer. If the event is postponed up to 30 days before the start of the activity, the organiser may charge a processing fee of 10% of the total cost of the booked event per person. Postponements made less than 30 days before the start of the activity will be invoiced in accordance with the above cancellation conditions or according to the actual costs incurred.

 

6. CANCELLATION OR CONTRACT AMENDMENTS BY THE ORGANISER

A minimum number of participants applies to various events. The organiser reserves the right to withdraw from the contract at short notice. If the contract cannot be fulfilled at another time or if the customer cannot accept the alternative services offered, the payments already made will be refunded, less the services already used. Further claims for compensation are excluded. The event may also be cancelled by the organiser at short notice if participants, through their behaviour, omissions or other actions, give cause for the fulfilment of the contract to be jeopardised or rendered impossible. In this case, the provisions of clause 5 shall apply with regard to cancellation costs. If an event or parts thereof cannot be held due to force majeure, safety concerns on the part of the organiser, official measures, strikes or unsafe weather and natural conditions, the organiser is entitled to cancel or discontinue the event at short notice. Payments made will be refunded, less any services already used, expenses and the processing fee. It should be noted that safe execution is in the interest of all parties. Decisions made by the activity leaders are final. The organiser expressly reserves the right to make changes to the event. The organiser will endeavour to provide equivalent replacement services.

 

7. CONDITIONS OF PARTICIPATION, PARTICIPANTS' OBLIGATIONS TO COOPERATE

Good health is a prerequisite for all activities. Participants undertake to inform the organiser of any health problems. Under no circumstances may participants be under the influence of drugs, alcohol, psychotropic drugs or similar substances.
The participant undertakes to comply with the conditions of participation and to strictly follow the instructions of the organiser, the pilot and assistants. If the conditions of participation are not met or the instructions are not followed, the organiser may exclude the participant from the activity.

 

8. INSURANCE

The pilot's liability towards the passenger is limited to a maximum of CHF 5,000,000.–

 

9. COMPLAINTS

Should the customer have cause for complaint or suffer damage, this must be reported immediately in writing to the activity leader or service provider and confirmed. However, the activity leader or service provider is not authorised to acknowledge claims, which is why such confirmation does not constitute an admission of liability. The activity leader or service provider will endeavour to remedy the situation within the scope of the event and the possibilities available. If no or insufficient remedy is provided, or if the customer wishes to assert claims for damages, the claims must be submitted in writing to the booking office, for the attention of the organiser, within 4 weeks of the contractual end of the activity. The complaint must be accompanied by the confirmation of the activity leader or service provider and any evidence. If the complaint is made late or not at all during the activity, or if the claim is submitted late to the booking office, all claims shall be forfeited.

 

10. GENERAL LIABILITY

Claims for damages against the organiser or its auxiliary persons are excluded, unless the damage was caused by intent or gross negligence. The organiser is entitled to engage auxiliary persons/third parties to provide services. If the organiser legitimately transfers the execution to a third party, the organiser shall not be liable for the actions and omissions of that third party. In particular, the organiser shall not be liable for damage caused by actions and omissions of the activity leader that are not related to the provision of contractually agreed services, due to actions of third parties, other participants, the participant (in particular clause 1), force majeure, natural events, official orders, etc., or due to delayed return home.

 

If a participant fails to follow the instructions of the organiser, activity leader, etc., the organiser shall not be held liable in any way.

 

10.1. LIABILITY FOR PARAGLIDING

The pilot's liability towards the passenger is limited to a maximum of CHF 5,000,000.–

 

11. APPLICABLE LAW AND PLACE OF JURISDICTION

Swiss law applies exclusively to the contractual relationship, excluding international agreements. The parties agree that Stans in Nidwalden shall be the exclusive place of jurisdiction. However, the organiser is also entitled to assert its claims at the customer's place of residence or registered office, at its own discretion. Should one or more provisions of these GTC be or become invalid and/or incomplete, the invalid and/or incomplete provision shall be replaced by a legally valid provision that comes closest to the invalid and/or incomplete provision in terms of its effectiveness. The invalidity and/or incompleteness of one provision shall not affect the validity of the other provisions. Participants from the USA or Canada expressly waive any jurisdiction in the USA or Canada and acknowledge that neither Paragliding Lake Lucerne GmbH nor the organiser will agree to any jurisdiction in the USA or Canada.
